INTRODUCTION

KEYWORDS:

  • Antitrust, antimonopoly in the Platform Economy/Taxation and Fair Competition/ Ethical Sourcing/Consumer protection and class litigation

On April 10, 2021, Alibaba, one of the largest e-commerce platforms in China, was fined RMB 18.2 billion by China’s market regulator for breaching the Anti-Monopoly Law, the highest fine on record in China. In the era of the electronic economy, monopoly and unfair competition affect all aspects of our lives. As Scott Galloway points out in the big four: amazon, apple, Facebook and Google’s intrinsic gene “, that Apple, Amazon, Facebook, and Google created hundreds of thousands of well-paid jobs, as well as unprecedented wealth at the same time, they also are:

  • “An enterprise hailed as a model of the Internet business refuses to pay sales tax, ignores labor laws and avoids taxes by various loopholes”;
  • “A company that uses a personal mobile phone as a monitoring device to analyze thousands of user portraits and sells this information to a Fortune 500 company”;
  • “An advertising platform in the search industry occupies 90% shares in the most promising sectors in many markets, but it avoids antitrust supervision through active litigation and lobbying”‘;

The 16th SCLA Global Forum-Global Anti-Unfair and Anti-Monopoly Compliance Forum will be held online from 13:00-15:30 Geneva time (19:00-21:30 Beijing time). This forum will not only discuss the global compliance risks and challenges faced by multinational companies, especially multinational Internet companies, from a practical perspective, but also reflect on the legal and ethical levels: Issues such as fair market, taxation and the link between antitrust and anti-unfair competition, and ethical procurement policies.
